Terms
1. DEFINITIONS & ENTIRE AGREEMENT
1.1. “Agreement” means these Terms and Conditions, any addenda (including the Fee Schedule/Annex), time-stamped photos/condition reports, and any Bonzah certificate or proof of your own insurance provided at booking.
1.2. “You/Your” means the renter named on Page 1 and every Authorized Driver; all are jointly and severally liable.
1.3. “We/Us/Company” means Fine Rental Cars LLC.
1.4. “Authorized Driver” means the renter and any additional driver we approve in writing and list on this Agreement, each properly licensed and meeting our age rules.
1.5. “Vehicle” means the automobile and all keys/fobs, plates, tires, tools, manuals, accessories, and documents.
1.6. “Loss or Damage” means any loss to the Vehicle from any cause, including collision, rollover, theft, vandalism, weather, flood, fire, glass/tires/undercarriage/interior, missing accessories/keys, towing/storage, administrative/appraisal fees, loss of use at our daily rental rate, and diminished value.
1.7. “Roadside Assistance (RSA)” means the optional add-on described below; it is not insurance and is separate from Bonzah or your own auto policy.
1.8. This Agreement is the entire agreement and supersedes all prior representations; headings are for convenience only.
2. NO WARRANTIES
2.1. The Vehicle is rented AS-IS.
2.2. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
3. PERMITTED USE, AGE & TERRITORY
3.1. Minimum age: 25 (or 21 only with our prior written approval, any underage fee, and increased deposit).
3.2. Prohibited uses (void any protection): off-road; racing/track/burnouts; towing/pushing; rideshare/delivery or carrying persons/property for hire; stunt or speed contests; driving with warning lights on or after damage; overloading/excess passengers; transporting illegal/hazardous items; disabling, tampering with or shielding GPS/telematics; leaving keys in the Vehicle or failing to lock it; providing false information; operation by anyone not an Authorized Driver.
3.3. Territory: operation is permitted only within the United States (contiguous 48 states). Mexico is prohibited.
4. VEHICLE CONDITION, PHOTOS & RETURN
4.1. You receive the Vehicle in good condition and will maintain fuel/charge, fluids, and tire pressure. No repair/service without our written consent.
4.2. Photo check-in/check-out required: within 30 minutes of pickup and return you must upload time-stamped photos (exterior/interior, odometer, fuel level). If you do not, you accept our condition report.
4.3. Return on the due date/time and at the agreed location, in the same condition (ordinary wear excepted).
5. TELEMATICS, GPS & PRIVACY
5.1. The Vehicle may contain GPS/telematics that capture location, speed, mileage, fuel/battery level, door/immobilizer status, and diagnostics.
5.2. We may use such data to enforce this Agreement and share it with law enforcement/insurers for theft, safety alerts, or as required by law.
5.3. Tampering/disablement fee: $250 plus damages.
6. INSURANCE OPTIONS (CHOOSE ONE)
6.1. Your Own Insurance – Primary. You will use your personal auto policy for both liability and physical damage to a rented vehicle; you will provide proof before pickup and keep coverage active. If your insurer denies/excludes any part of a loss, you remain fully responsible.
6.2. Bonzah Protections (third-party). If you elect Bonzah products, you understand Bonzah is a third-party provider; all limits, exclusions, and claims procedures are governed solely by the Bonzah certificate/policy.
CDW – Collision Damage Warranty: $26.95/day, up to $35,000, deductible $500.
RCLI – Contingent Liability Insurance: $20.18/day, covers third-party liability (state minimums).
SLI – Supplemental Liability Insurance: $11.20/day, up to $100,000 per person / $500,000 per accident (excess).
PAI – Personal Accident Insurance: $6.90/day, renter loss of life $50,000; passenger $5,000; accidental medical $1,000.
7. OPTIONAL ROADSIDE ASSISTANCE (RSA) — NOT INSURANCE
7.1. $3.29/day.
7.2. Covers: lock-out, jump-start, flat-tire assist (if spare available), towing up to 25 miles.
7.3. Limit: 1 event/24h, max 2 per rental.
7.4. Service area: Dallas–Fort Worth metro.
7.5. Excludes: consumables (fuel, tires, fluids, keys/fobs).
7.6. Mechanical failures not caused by renter: handled by us at no cost.
8. RESPONSIBILITY FOR LOSS OR DAMAGE
8.1. You are responsible for all Loss or Damage, regardless of fault, except to the extent expressly covered by your insurance or Bonzah (if elected).
9. MILEAGE & FUEL
9.1. Default: 200 miles/day.
9.2. Extra miles: $0.50/mile.
9.3. Fuel: return at same level or pay $5/gal + $20 service fee (unless prepaid refuel purchased).
10. CLEANING, SMOKING & PETS
10.1. No smoking/vaping. Fee: $100–$150 depending on treatment.
10.2. Pets only with written approval.
11. TOLLS, TICKETS, IMPOUNDS
11.1. You are responsible for all tolls, tickets, violations, towing, and impounds.
11.2. Admin fees apply.
12. CHARGES, FEES & PAYMENT AUTHORIZATION
12.1. Security deposit required.
12.2. You authorize charges for rental fees, extras, damages, cleaning, fuel, mileage, tolls, tickets, towing, repossession, admin fees, and legal costs.
12.3. Late Return Fee: $11/hour up to 4 hours; after 4 hours = full daily rate + 10% penalty.
13. ACCIDENT/THEFT PROCEDURE
13.1. Call 911 if needed, obtain a police report, take photos, notify us immediately.
14. FAILURE TO RETURN; REPOSSESSION
14.1. Failure to return may be considered theft by conversion.
14.2. Remote disable/recovery may apply.
15. PRIVACY & DATA USE
15.1. By using our services, you consent to collection and processing of your personal data (driver’s license, contact info, payment, telematics, reservation history) as needed for rental operations, legal compliance, and safety.
15.2. All data handling is governed by our Privacy Policy, which is incorporated by reference.
16. GOVERNING LAW & DISPUTES
16.1. This Agreement is governed by the laws of the State of Texas.
16.2. Venue lies in the state or federal courts of Collin County, Texas, or, at our election, disputes shall be resolved by binding arbitration under the AAA Consumer Rules in Collin County, Texas.
16.3. Jury-trial and class-action waivers apply to the fullest extent permitted by law.
16.4. The prevailing party is entitled to reasonable attorneys’ fees and costs.
17. E-SIGNATURES & COMMUNICATIONS
17.1. You consent to electronic signatures and to receive agreements, notices, receipts, and invoices electronically via email/SMS to the contact information you provided.
18. MODIFICATIONS; SEVERABILITY; WAIVER
18.1. No term is waived or modified unless in a signed writing by us.
18.2. If any provision is unenforceable, the remainder remains in effect.
18.3. No waiver of a breach is a waiver of any other breach.
19. ANNEX A — FEE SCHEDULE & OPTIONAL PRODUCTS
Optional Extras (if selected):
Extra Driver: $11.00 one-time
Child Seat: $22.00 one-time
Prepaid Refuel: $50.00 one-time
Roadside Assistance: $3.29/day
Unlimited Mileage: $82.50/day
Long Distance Package (100 extra miles/day): $22.00/day
Triggered Fees (if applicable):
Cleaning: Light $25, Deep $100
Smoking/Vaping remediation: $100–$150
Fuel refill (if prepaid not purchased): $5/gal + $20 service fee
Late Return: $11/hour up to 4 hours; beyond 4 hours = full daily rate + 10% penalty
Excess Mileage: $0.50/mile
Tolls: toll amount + $15 admin fee
Tickets/violations: violation + $25 admin fee
Lock-out: $95 (+ key replacement if needed)
Jump-start: $75
Fuel delivery: $85 + fuel cost
Flat tire assist: $95
Tow (non-accident): $175 + $6/mile
Lost key/fob: $300
Lost/damaged lockbox: $75
GPS/telematics tampering: $250 + damages
Repossession: $50 + $5/mile + costs
Loss of use: daily rental rate per day of downtime
Diminished value & admin/appraisal fees: per industry standards
Notes: Amounts are before applicable taxes. Fees may be cumulative and charged in addition to repairs, loss of use, and diminished value, consistent with the Terms and Conditions above.
