DEFINITIONS & ENTIRE AGREEMENT
“Agreement” means these Terms and Conditions, any addenda (including the Fee Schedule/Annex), time-stamped photos/condition reports, and any Bonzah certificate or proof of your own insurance provided at booking. “You/Your” means the renter named on Page 1 and every Authorized Driver; all are jointly and severally liable. “We/Us/Company” means the rental company identified on Page 1. “Authorized Driver” means the renter and any additional driver we approve in writing and list on this Agreement, each properly licensed and meeting our age rules. “Vehicle” means the automobile and all keys/fobs, plates, tires, tools, manuals, accessories and documents. “Loss or Damage” means any loss to the Vehicle from any cause, including collision, rollover, theft, vandalism, weather, flood, fire, glass/tires/undercarriage/interior, missing accessories/keys, towing/storage, administrative/appraisal fees, loss of use at our daily rental rate, and diminished value. “Roadside Assistance (RSA)” means the optional add-on described below; it is not insurance and is separate from Bonzah or your own auto policy. This Agreement is the entire agreement and supersedes all prior representations; headings are for convenience only.

NO WARRANTIES
The Vehicle is rented AS-IS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

PERMITTED USE, AGE & TERRITORY
a) Minimum age: 25 (or 21 only with our prior written approval, any underage fee, and increased deposit).
b) Prohibited uses (void any protection): off-road; racing/track/burnouts; towing/pushing; rideshare/delivery or carrying persons/property for hire; stunt or speed contests; driving with warning lights on or after damage; overloading/excess passengers; transporting illegal/hazardous items; disabling, tampering with or shielding GPS/telematics; leaving keys in the Vehicle or failing to lock it; providing false information; operation by anyone not an Authorized Driver.
c) Territory: operation is permitted only within the United States (contiguous 48 states) unless we agree in writing. Mexico is prohibited.

VEHICLE CONDITION, PHOTOS & RETURN
a) You receive the Vehicle in good condition and will maintain fuel/charge, fluids and tire pressure. No repair/service without our written consent.
b) Photo check-in/check-out required: within 30 minutes of pickup and return you must upload time-stamped photos (exterior/interior, odometer, fuel level). If you do not, you accept our condition report.
c) Return on the due date/time and at the agreed location, in the same condition (ordinary wear excepted) with all keys/fobs, accessories and documents. Late return charges apply (see Fee Schedule) and continued possession may constitute conversion/theft by failure to return.

TELEMATICS, GPS & PRIVACY
The Vehicle may contain GPS/telematics that capture location, speed, mileage, fuel/battery level, door/immobilizer status, and diagnostics. We may use such data to enforce this Agreement and share it with law enforcement/insurers for theft, safety alerts, or as required by law. Tampering/disablement fee: $250 plus damages. If equipped, you consent to remote disable/recovery for breach, theft, or failure to return.

INSURANCE OPTIONS (CHOOSE ONE)
(A) Your Own Insurance – Primary. You will use your personal auto policy for both liability and physical damage to a rented vehicle; you will provide proof before pickup and keep coverage active. If your insurer denies/excludes any part of a loss, you remain fully responsible under this Agreement.
(B) Bonzah Protections (third-party). If you elect Bonzah products, you understand Bonzah is a third-party provider; we are not an insurer. All limits, exclusions and claims procedures are governed solely by the Bonzah certificate/policy, which is incorporated by reference and provided/linked at booking. We may receive compensation for facilitating Bonzah products.

6.1 Bonzah summary (policy controls; for convenience only)
– CDW – Collision Damage Warranty (mandatory if Bonzah is chosen): $26.95 / 24h, primary for collisions between vehicles; up to $35,000 to the rental vehicle; deductible up to $500; not liability coverage. Amounts over limits or excluded (including keys, tires, glass, undercarriage/interior, towing/storage, loss of use, diminished value, admin fees) are your responsibility.
– RCLI – Renter’s Contingent Liability Insurance: $20.18 / 24h, primary liability to third parties when you are at fault; meets state minimum limits; not damage to the rental vehicle.
– SLI – Supplemental Liability Insurance: $11.20 / 24h, excess/secondary liability; must be purchased with RCLI; up to $100,000 per person and $500,000 per accident; excess property damage up to $10,000; not damage to the rental vehicle.
– PAI – Personal Accident Insurance: $6.90 / 24h; renter loss of life $50,000; passenger $5,000; accidental medical $1,000; personal effects $500; not damage to the rental vehicle.

6.2 Order of coverage & claims
– Physical damage to the Vehicle: If CDW is purchased, CDW is primary up to its limits and subject to its deductible/exclusions; any shortfall is your responsibility. If you rely on your own insurance or decline CDW (where allowed), you remain responsible to the extent insurance is unavailable or denied.
– Liability to third parties: Your own policy is primary when used. If RCLI is purchased it is primary up to state minimums; if SLI is also purchased, SLI applies excess to those limits.
– Claims & cooperation: Call 911 as appropriate, obtain a police report, notify us immediately, and file a Bonzah claim if applicable, providing photos and all requested information. Failure to report/cooperate may void coverage and you remain liable.

OPTIONAL ROADSIDE ASSISTANCE (RSA) — NOT INSURANCE
7.1 What it is. RSA is an optional daily add-on that waives our call-out fees for certain non-accident incidents. It is not insurance, is separate from Bonzah and any personal auto policy, and does not cover consumables or replacements (fuel, keys/fobs, tires/wheels, fluids). If your personal auto policy includes roadside assistance, you may decline RSA and use your own assistance.
7.2 Plan & limits (DFW service area). Roadside Assistance — US$ 5.99/day: lock-out, jump-start, fuel delivery (fuel charged at pump price), flat-tire assistance when a usable spare is available, and towing up to 25 miles per incident. Frequency limits: max 1 event per 24 hours and 2 events per rental. Service area: Dallas–Fort Worth metro counties (Dallas, Tarrant, Collin, Denton, Rockwall, Kaufman, Ellis). Outside this area or beyond included tow miles, an over-mileage fee of US$ 5.00 per mile or the provider’s pass-through, whichever is higher, applies. Mechanical failures not caused by the renter are handled by us at no cost, regardless of RSA selection.
7.3 Exclusions. RSA does not apply to accidents/collisions, off-road or other prohibited uses, repeated/abusive calls, or situations requiring parts/consumables (fuel, tires/wheels, keys/fobs, fluids), which are the renter’s responsibility. If RSA is declined or limits are exceeded, pay-per-event fees apply (see Annex A).

RESPONSIBILITY FOR LOSS OR DAMAGE
To the fullest extent permitted by law, you are responsible for all Loss or Damage to the Vehicle, regardless of fault, except to the extent expressly covered by your own policy or by Bonzah (if elected). Your responsibility includes parts/labor, towing/storage, loss of use at our posted daily rental rate, diminished value, administrative/appraisal fees and all amounts not covered because of deductibles, exclusions or policy limits. Damage arising from Prohibited Uses or operation by an unauthorized driver voids any protection.

MILEAGE & FUEL
Default allowance: 200 miles/day (prorated). Excess mileage: $0.50 per mile. Return fuel at the same level or pay $5.00 per gallon plus a $20 service fee (if Prepaid Refuel Service was not purchased).

CLEANING, SMOKING & PETS
No smoking/vaping of any substance. Pets only with our prior written approval. Fees apply per the Fee Schedule.

TOLLS, TICKETS, IMPOUNDS & AUTHORITIES
You are responsible for all tolls, tickets, citations, camera violations, towing and impounds from pickup until we physically recover the Vehicle. You authorize us to share your information with authorities and to charge amounts due plus admin fees (see Fee Schedule).

CHARGES, FEES & PAYMENT AUTHORIZATION
You will pay on demand: (i) time-and-mileage; (ii) optional products; (iii) taxes; (iv) all amounts arising from Loss or Damage; (v) costs to locate/disable/repossess; (vi) reasonable collection costs and attorneys’ fees; (vii) late payment fee 2% per month or the maximum allowed by law; and (viii) interest on unpaid balances at the maximum allowed by Texas law.
Deposit & Card Authorization. You authorize a security deposit/authorization and authorize us to charge your card on file for all amounts due, including deductibles, uncovered/excess losses, loss of use, diminished value, admin fees, towing/storage/impound, cleaning/smoking/pet fees, keys/lockbox, fuel, tolls/tickets plus admin fees, and reasonable attorneys’ fees. Unused deposit releases per your bank’s timelines. You agree not to dispute charges consistent with this Agreement and will provide documentation within 5 business days if you do.

ACCIDENT/THEFT PROCEDURE
Call 911 as appropriate; obtain a police report; take photos/video; exchange information; and notify us immediately. Do not admit fault. Driving a damaged Vehicle is prohibited.

FAILURE TO RETURN; REPOSSESSION; THEFT BY CONVERSION
If you fail to return the Vehicle when due or breach this Agreement, we may remotely disable (if equipped) and repossess at your expense without notice. 72 hours after failure to return (or earlier where permitted) we may report the Vehicle as stolen; continued possession may constitute theft by conversion. You waive claims arising from lawful repossession.

INDEMNITY
To the fullest extent permitted by law, you will indemnify, defend and hold harmless the Company and its owners/employees/insurers from all claims, losses, damages, fines and fees arising from your use/possession of the Vehicle, except to the extent caused by our gross negligence or willful misconduct.

LIMITATION OF LIABILITY
Unless prohibited by law, we are not liable for consequential, incidental, special, exemplary or punitive damages, including lost profits or time, even if advised of the possibility.

GOVERNING LAW; VENUE; DISPUTE RESOLUTION
This Agreement is governed by Texas law. Venue lies in the state or federal courts of Collin County, Texas, or, at our election, disputes shall be resolved by binding arbitration under the AAA Consumer Rules in Collin County, Texas. Jury-trial and class-action waivers apply to the fullest extent permitted by law. The prevailing party is entitled to reasonable attorneys’ fees and costs.

E-SIGNATURES & COMMUNICATIONS
You consent to electronic signatures and to receive agreements, notices, receipts, and invoices electronically via email/SMS to the contact information you provided.

MODIFICATIONS; SEVERABILITY; WAIVER
No term is waived or modified unless in a signed writing by us. If any provision is unenforceable, the remainder remains in effect. No waiver of a breach is a waiver of any other breach.

ANNEX A — FEE SCHEDULE & OPTIONAL PRODUCTS

(A) Optional mileage & add-ons (if selected on the reservation)
• Roadside Assistance — US$ 5.99 per day
• Unlimited mileage — $75.00 per day
• Long distance package — 100 miles included per day — $20.00 per day
• Extra driver — $10.00 one-time (per approved additional driver)
• Child seat — $20.00 one-time
• GPS Navigation — $50.00 one-time (if available)
• Prepaid Refuel Service — $50.00 one-time (optional)

(B) Triggered fees (if the situation occurs)
• Cleaning: Light $25.00; Deep $100.00
• Smoking/Vaping remediation: $100.00–$150.00 depending on severity/ozone treatment
• Post-return fuel (when Prepaid Refuel Service was not purchased): $5.00 per gallon + $20.00 service fee
• Late return: $25.00 per hour (max $150.00/day) + applicable daily rental; impacts to subsequent reservations may result in additional actual costs
• Excess mileage: $0.50 per mile above the applicable allowance (unless Unlimited was purchased)
• Tolls: toll amount + $15.00 admin fee per occurrence
• Tickets/violations: violation amount + $25.00 admin fee per occurrence
• Roadside pay-per-event (when RSA is declined, excluded or limits exceeded):
– Lock-out (keys inside/lost): $95.00 (+ cost of replacement key/fob if needed)
– Jump-start (battery): $75.00
– Fuel delivery: $85.00 + fuel at pump price
– Flat-tire assist (with usable spare): $95.00
– Tow (non-accident): $175.00 base + $6.00/mile
– RSA over-mileage / outside area: $5.00/mile or provider pass-through, whichever is higher
• Tire/wheel replacement, keys/fobs, lockbox or other parts/consumables: third-party cost + $50.00 admin
• Lost key/fob: $300.00
• Lost/damaged lockbox: $75.00
• GPS/telematics tampering: $250.00 + resulting losses/damages
• Repossession/recovery: $50.00 base + $5.00 per mile from the renting location to the recovery point + third-party costs
• Loss of use: our daily rental rate for each day of downtime due to damage, as permitted by law
• Diminished value & Admin/Appraisal fees: per industry-accepted methods/insurer standards

Notes: amounts are before tax; fees may be cumulative and charged in addition to repairs, loss of use and diminished value, consistent with the Terms and Conditions above.
